Is ICE deliberately re-arresting migrants released by federal court orders to evade judicial oversight?Source

ICE re-arrested people freed by judges; the legal question is whether each new detention honored or evaded those orders.
Courts ordered detainees released, while ICE sometimes re-arrested them or continued custody under a new legal theory. Reports and court records show repeated incidents, but they do not establish that every re-arrest was centrally directed to evade judges. The key test is whether each new detention had lawful grounds and respected the original order.

At Whipple, release papers became a doorway to another arrest. That turns habeas into a revolving door, not a remedy.
Within minutes of signing release papers at Minnesota’s Whipple building, migrants were reportedly detained again. Court records and lawyers describe transfers, delayed releases and new custody claims, with at least 20 cases reported. The danger is bigger than one tactic: a government can make judicial relief meaningless by changing the door, the place and the legal theory.

ICE Is Now Arresting People Who’ve Been Released From ICE Detention By Court Orders
News reporting
US federal court have overwhelmingly ruled ( 10,000 orders and counting ) that migrants are — just like natural-born citizens — entitled to constitutional rights. Among them is the right to due process. This means that detained migrants have a right to a hearing to see whether they can be held in custody until a hearing on the issue. And that issue is whether or not they can be held indefinitely.
