The Story
The phone was wiped during a border search; the court must decide whether the search and the obstruction charge were lawful.
Border authorities detained Tunick, sought to inspect his device, and now accuse him of using a duress code to obstruct seizure. Prosecutors have not charged him with a child-sexual-abuse offense. The central question is whether border-search powers and the evidence-destruction charge survive challenges over the search, the officers’ statements, and access to counsel.
- Tunick was charged with destroying property or digital contents to prevent government seizure, not with possessing child-abuse material.
- CNN described the case as a potential test of how Fourth Amendment protections apply to searches of Americans’ devices at the border.
- Tunick pleaded not guilty, and his lawyers moved to suppress evidence while challenging the underlying search.

Deeper Insight
At the border, a terrifying accusation can do political work. That should worry anyone with a phone.
One internal alert tied Tunick’s device search to suspected terrorism activity linked to his activism. Officers told him they sought child-abuse material instead. His lawyers call that explanation fabricated, while prosecutors charge him over a duress code that wiped the phone. The court fight will test whether border power can hide political scrutiny behind public fear.
- The reported internal alert directed agents to scrutinize Tunick’s devices over suspected terrorist activities connected to his activism, while officers told him they sought child-abuse material.
- Tunick’s lawyers allege the child-exploitation explanation was fabricated; a defense account says an officer admitted there was no basis to believe he possessed child pornography.
- Earlier disclosures described DHS border searches of activists’ electronic devices without reasonable suspicion or judicial approval, showing the broader power at issue is not unique to Tunick’s case.
