Evidence strength: The program’s design and purpose are well documented. The dissent concerned whether embedding government access into commercial encryption appropriately balanced privacy, security, and lawful surveillance—not what the key-escrow mechanism was.

The Clipper Chip was a built-in surveillance gateway: strong encryption wrapped around a government-held backdoor.
Summary
The program was a government-industry proposal to deploy strong encryption in commercial telecommunications while retaining a controlled decryption capability. Its central mechanism divided each device’s unique key between two escrow agencies, with release procedures tied to legally authorized wiretaps. Supporters presented this as a balance between privacy and public safety.
- Technical designKey escrow allowed government agencies to recover message content without breaking the underlying cipher, provided they obtained the required key components.
- Legal accessThe proposed release process was designed for communications intercepted under lawful wiretap authority.
- Clipper was announced as a voluntary initiative to improve communications security and privacy while meeting law-enforcement needs.
- The escrowed key was split into two components, with both required for decryption.
- The program used strong encryption but preserved a government access mechanism for authorized wiretaps.
Deeper Insight
The Clipper Chip split one key between two escrow agents. That “safety valve” made surveillance part of private communication by design.
In 1993, the Clipper Chip promised strong phone encryption with a key split between two escrow agents for authorized wiretaps. But the government-held access route and secret Skipjack cipher made trust part of the security model. Once privacy has a built-in back door, legality is only one layer of protection.
- What it could changeEncryption could be judged by who can unlock it, not just by how hard it is to break.
- How it touches todayEvery private message depends on whether access was designed into the system before anyone used it.
- Our futurePrivate communication could become permission-based, with trust placed in the same authorities it was meant to shield us from.
- The design sent or retained material that allowed a government-held key to recover session keys and decrypt intercepted communications.
- The secrecy surrounding Skipjack prevented independent evaluation by the broader cryptographic research community during the initial period.
- Privacy advocates characterized Clipper as a mechanism for government access to otherwise private communications, even when marketed as legally controlled.
